CamOnArt – Terms of Service

These Terms of Service (“Terms”) govern all services provided by CamOnArt Inc. (“CamOnArt”, “we”, “our”, “us”). By booking or using our services, you agree to be legally bound by these Terms.

1. Services Provided

CamOnArt provides professional real estate media services including, but not limited to:

• Real estate photography
• Videography
• Aerial/drone imaging
• 3D virtual tours
• Floor plans
• Property websites and related digital media

All services are performed by trained photographers and operators contracted or employed by CamOnArt.

2. Client Responsibilities & Property Access

The client confirms that they have legal authority to grant access to the property and to authorize CamOnArt to capture and use media for marketing and advertising purposes.

The client is responsible for ensuring:

• The property is accessible at the scheduled time
• The property is safe for entry
• Utilities are operational
• The property is photo‑ready

CamOnArt is not responsible for delays or service limitations caused by denied access, unsafe conditions, or unprepared properties.

3. Property Size & Package Limits (Ontario‑compliant wording)

If the property’s total square footage exceeds the limit of the package selected at the time of booking, CamOnArt reserves the right to apply the applicable higher rate based on the actual size of the property, as determined on site or through available records.

Any pricing adjustments will be invoiced accordingly and are payable immediately.

4. Ownership & Licensing of Content

All photographs, videos, virtual tours, floor plans, and digital media produced by CamOnArt remain the exclusive intellectual property of CamOnArt under the Copyright Act (Canada).

Clients are granted a limited, non‑exclusive, non‑transferable license to use the delivered content solely for:

• Marketing the specific property photographed
• The client’s professional self‑promotion

Resale, sublicensing, transfer, or third‑party commercial use is strictly prohibited without written authorization from CamOnArt.

5. Editing & Revisions

• Content is delivered “as‑is” based on CamOnArt’s professional standards.
• Up to three (3) reasonable revision requests are permitted.
• Editing time is limited to a maximum of eight (8) hours per property.
• Additional revisions or editing beyond this scope may incur additional fees.

6. Payments & Fees

Full payment is required prior to or upon service delivery unless otherwise agreed in writing.

Accepted payment methods include:

• Visa, Mastercard, American Express, Discover
• Interac / E‑Transfer
• Cash
• Cheque
• Apple Pay / Google Pay

Credit card payments may include a processing fee where permitted by law.

CamOnArt reserves the right to charge stored payment methods for:

• Outstanding balances
• Package upgrades
• Travel fees
• Parking fees
• Not‑ready fees
• Late cancellations or no‑shows

7. Cancellations & No‑Shows

• Cancellations or rescheduling require a minimum of 48 hours’ notice.
• Same‑day cancellations or no‑shows are charged 100% of the package price.
• If service is interrupted or cancelled while the photographer is on site, full payment remains due.

8. No‑Refund Policy

Due to the digital and custom nature of the services:

• All completed and delivered services are non‑refundable.
• Refunds are only considered where legally required.

9. 3D Virtual Tours Hosting

• Includes 90 days of hosting at no charge
• Thereafter: $9.99 CAD/month per property
• Cancellation must be submitted online
• Refunds available only within 7 days of initial charge
• Reactivation fee: $79.99 CAD

10. Photo Downloads & Storage

Clients must download all delivered files within 72 hours of delivery.

CamOnArt is not responsible for file retention beyond this period unless otherwise stated.

11. Floor Plans Disclaimer

• Provided for marketing and illustrative purposes only
• Not certified for legal or architectural use
• Not RMS compliant in Ontario or Alberta
• Measurements may vary by up to approximately 5%

12. Unlimited Photo Policy

Subject to time and operational limits:

• Up to 50 photos for properties under 4,000 sq. ft.
• Up to 80 photos for properties over 4,000 sq. ft.

13. Drone & Weather‑Dependent Services

Drone services are subject to:

• Weather conditions
• Transport Canada regulations
• Airspace restrictions

Completed drone services are non‑refundable. Rescheduling may incur additional fees.

14. Liability & Risk Allocation

Clients assume all risks related to property conditions, including theft, damage, injury, or loss occurring during service delivery, except where caused by CamOnArt’s proven gross negligence.

CamOnArt is not liable for:

• Indirect or consequential damages
• Website downtime
• Third‑party platform failures

Pets must be secured during service. Clients are responsible for damages caused by animals.

15. Third‑Party Platforms

CamOnArt does not guarantee the availability, uptime, or functionality of MLS systems, real estate portals, or third‑party hosting platforms.

16. Modifications

CamOnArt reserves the right to modify services, pricing, or these Terms at any time without prior notice. Updated terms take effect upon posting to the website.
